1. Introduction

Welcome to the Photography Society of Hongkongers in Australia (PSHKA). These Terms and Conditions outline the rules and guidelines for membership and participation in PSHKA events. By becoming a member or participating in any of our events, you agree to abide by these terms. PSHKA organizes a variety of events, including morning photo chats, photo idea sharing, outdoor photo walks, and image evaluations. These terms and conditions govern your participation and outline the responsibilities of both PSHKA and its members.

2. Membership

  • Eligibility:
    Membership is open to all photography enthusiasts who can communicate in either Cantonese or English. Additionally, specific membership tiers cater to different groups, such as Students, Adults, International Members, Concession Members, and VIP Life Members.

  • Membership Types:

    • Student Subscription

    • Adult Subscription

    • International Subscription

    • Concession Subscription

    • VIP Life Membership

  • Fees:
    Membership fees, where applicable, must be paid in full before gaining access to any member benefits. Fees are non-refundable unless otherwise stated.

  • Renewal and Cancellation:
    Memberships are set to auto-renew either monthly or annually based on the initial setting selected during membership signup. Members can cancel their membership at any time through our website. To ensure cancellation before the next renewal, please cancel at least 30 days before your scheduled renewal date.

  • Responsibilities:
    Members are expected to engage respectfully in all activities, adhere to the code of conduct, and fulfil any obligations specific to their membership type.

3. Code of Conduct

  • Respectful Behaviour:
    Members must behave respectfully toward one another, maintain a supportive environment, and refrain from inappropriate or disruptive behaviour.

  • Inclusivity:
    PSHKA values diversity and inclusivity. Discriminatory or harassing behaviour will not be tolerated.

  • Consequences:
    Violations of the code of conduct may result in termination of membership without refund. Members can report violations confidentially to the PSHKA.

4. Event Participation

  • Assumption of Risk:
    By participating in PSHKA events, you acknowledge that photography activities, especially outdoor photo walks, may involve certain inherent risks, including but not limited to physical exertion, uneven terrain and exposure to the elements. You voluntarily assume all risks associated with these activities.

  • Third-Party Venues:
    PSHKA may organize events in venues such as cafes, which are not operated by the society. Members are responsible for any personal expenses, including food and beverages purchased during these events.

  • Personal Expenses:
    All participants are responsible for their own expenses, including but not limited to travel costs, food and equipment.

  • Safety Guidelines:
    Participants are encouraged to follow safety guidelines provided during events. PSHKA is not responsible for any damage or loss of personal equipment. Members should ensure their equipment is secure and appropriate for the event type.

5. Liability Waiver

  • Limitation of Liability:
    PSHKA and its organizers are not liable for any personal injury, property damage, or loss incurred during any events, whether held in person or online. Participation is at your own risk.

  • Indemnification:
    Members agree to indemnify and hold harmless PSHKA, its members, and organizers from any claims arising from their participation in events.

6. Photography and Media Release

  • Consent to Photograph:
    By attending PSHKA events, you agree to being photographed or recorded. These images may be used by PSHKA for promotional purposes, including on the website and social media platforms.

  • Use of Images:
    Photographs and videos taken during events may be used for promotional purposes, including on the PSHKA website and social media channels. Members who prefer not to be included in photographs should inform the event organizer in advance.

  • Opt-Out Options:
    If you do not wish to be photographed, please inform the event organizer before or during the event.

7. Privacy Policy

  • Data Collection:
    PSHKA collects personal information, such as names and email addresses, for the purpose of event organization and membership management.

  • Use of Data:
    Your data will be used to communicate with you regarding PSHKA events, updates, and announcements. We do not share your personal information with third parties without your consent.

  • Data Retention:
    Personal information will be retained for as long as necessary to fulfil the purposes outlined in this policy. Members can request access to or correction of their personal data by contacting us.

  • Data Security:
    We take reasonable precautions to protect your data but cannot guarantee complete security. By providing your personal information, you acknowledge that no data transmission over the internet is entirely secure.

8. Intellectual Property Rights

  • Member Content:
    Any photographs or creative content shared during events remain the intellectual property of the member. By sharing your work, you grant PSHKA a non-exclusive, royalty-free license to display your work on our website and promotional materials with proper credit.

  • Use of Club Materials:
    All PSHKA event materials, including guides, tutorials, and event recordings, are the intellectual property of PSHKA and may not be reproduced or distributed without permission.

  • Content Removal:
    Members can request the removal of their content at any time by contacting us.

9. Event Changes and Cancellations

  • Right to Modify:
    PSHKA reserves the right to modify or cancel events at any time due to unforeseen circumstances such as adverse weather, insufficient registration, or other factors beyond our control.

  • Notification:
    Members will be notified of any changes or cancellations via email and our website as soon as possible.

  • Refund Policy:

    • Event Cancellation:
      If an event is cancelled due to unforeseen circumstances, PSHKA will make every effort to reschedule the event to a later date. Members will be notified of the rescheduled date as soon as possible. If rescheduling is not feasible, PSHKA may offer alternative arrangements, such as transferring membership benefits or credits for future events.

    • Voluntary Withdrawal:
      Refunds are not available for voluntary withdrawal from events. Members are encouraged to commit to attending events once registered to help PSHKA manage event planning effectively.

    • Exceptions:
      In exceptional cases where rescheduling is not possible and no suitable alternative can be provided, PSHKA may consider providing refunds on a case-by-case basis. Such decisions will be made at the discretion of the PSHKA.

10. Termination of Membership

  • Grounds for Termination:
    PSHKA reserves the right to terminate memberships for violations of the code of conduct, non-payment of fees, or behaviour detrimental to the society.

  • Process:
    Members will be notified in writing of any potential termination. A formal review will be conducted by the PSHKA to assess the situation before any final decision is made.

  • Appeal Process:
    Members have the right to appeal termination decisions. To initiate an appeal, submit a written request to the PSHKA within 14 days of receiving the termination notification. We will review the appeal and provide a final decision within 30 days of receiving the request. Decisions made through the appeal process are final.

11. Dispute Resolution

  • Complaints Procedure:
    Any complaints or disputes should be directed to the PSHKA. We will endeavour to resolve any disputes in a fair and timely manner.

  • Resolution Process:
    If a dispute cannot be resolved internally, the parties agree to seek mediation facilitated by the PSHKA before pursuing any further legal action.

12. Governing Law

  • Jurisdiction:
    These terms and conditions are governed by the laws of the Australian Capital Territory (ACT). Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts of the ACT.

  • Compliance Statement:
    These terms and conditions comply with the relevant laws and regulations of the Australian Capital Territory (ACT).

13. Acceptance of Terms

By joining PSHKA or participating in any events, you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions. It is your responsibility to review these terms regularly for any updates or changes.

14. Amendments

PSHKA reserves the right to amend these Terms and Conditions at any time. Members will be notified of any changes via email or our website. Continued participation in PSHKA activities after such changes constitutes acceptance of the amended terms.
